بِمَا مِّنَ ﴿٣٨﴾

Translation

Saheeh International

[As for] the thief, the male and the female, amputate their hands in recompense for what they committed as a deterrent [punishment] from Allah. And Allah is Exalted in Might and Wise.

کیفر سرقت

قرآن در حکم این آیه نیز همانند سایر احکام» ریشةٌ مطلب را بیان کرده و شرح آن را به سنت پیامبر(ص) واکذار نموده است. از مجموع روایات اسلامی استفاده می شود که اجرای این حد اسلامی (بریدن دست دزد)» شرایط زیادی دارد که بدون وجود آنها این کار جایز نیست (شرح آن در کتب فقمی آمده است). البته هر نوع دزدی به هر شکل و اندازه در اسلام حرام است؛ اما حدٌ بریدن دست تنها در صورت جمع شدن شرایط آن اجرا می‌شود. در میان فقهای ما معروف این است که اندازة قطع دست سارق.» تنما چهار انگشت دست راست وی استء نه بیشتر؛ اگر چه فقهای اهل تستن» بیش از آن گفته‌اند. > **Cited sources** (grade before any load-bearing use): Tafsīr al-Qummī.

  • وَٱلَّذَانِ يَأْتِيَٰنِهَا مِنكُمْ فَـَٔاذُوهُمَا فَإِن تَابَا وَأَصْلَحَا فَأَعْرِضُوا۟ عَنْهُمَآ إِنَّ ٱللَّهَ كَانَ تَوَّابًا رَّحِيمًا

    And the two who commit it among you, dishonor them both. But if they repent and correct themselves, leave them alone. Indeed, Allah is ever Accepting of repentance and Merciful.

  • وَجَزَٰٓؤُا۟ سَيِّئَةٍ سَيِّئَةٌ مِّثْلُهَا فَمَنْ عَفَا وَأَصْلَحَ فَأَجْرُهُۥ عَلَى ٱللَّهِ إِنَّهُۥ لَا يُحِبُّ ٱلظَّٰلِمِينَ

    And the retribution for an evil act is an evil one like it, but whoever pardons and makes reconciliation - his reward is [due] from Allah. Indeed, He does not like wrongdoers.
