But if it is found that those two were guilty of perjury, let two others stand in their place [who are] foremost [in claim] from those who have a lawful right. And let them swear by Allah, "Our testimony is truer than their testimony, and we have not transgressed. Indeed, we would then be of the wrongdoers."

But if it is found that both of them were guilty of a sin, then two others shall stand up in their place from among those nearest in kinship to the claimants and swear by Allah: ‘Our testimony is surely truer than their testimony, and we have not transgressed, for then we would indeed be among the wrongdoers.’

But then, if it is afterwards ascertained that both of them merit (the suspicion of) sin, let two others take their place of those nearly concerned, and let them swear by Allah, (saying): Verily our testimony is truer than their testimony and we have not transgressed (the bounds of duty), for them indeed we should be of the evil-doers.

But if it gets known that these two were guilty of the sin (of perjury), let two others stand forth in their places,- nearest in kin from among those who claim a lawful right: let them swear by Allah: "We affirm that our witness is truer than that of those two, and that we have not trespassed (beyond the truth): if we did, behold! the wrong be upon us!"

But if it be discovered that both of them have merited the accusation of any sin, then two others shall stand in their place, these being the nearest of those most concerned, and they shall swear by God, 'Our testimony is truer than their testimony, and we have not transgressed, for then we would assuredly be among the evildoers.'

پس اگر اطلاعی حاصل شود که آن دو شاهد [با شهادت ناحقّ خود] مرتکب گناه شده اند، دو شاهد دیگر از کسانی که به میّت نزدیک تر [و از کم و بیش وصیت آگاه تر] ند به جای آن دو شاهدِ [خائن] می ایستند، و به خدا سوگند می خورند که شهادتمان از شهادت آن دو نفر درست تر و به حق نزدیک تر است، و [در شهادتی که بر خلاف شهادت آنان می دهیم] بنای تجاوز از حق را نداریم، [که اگر داشته باشیم] قطعاً از ستمکاران خواهیم بود.

و اگر معلوم شد که آن دو دستخوش گناه شده‌اند، دو تن دیگر از کسانی که بر آنان ستم رفته است، و هر دو [به میت‌] نزدیکترند، به جای آن دو [شاهد قبلی‌] قیام کنند؛ پس به خدا سوگند یاد می‌کنند که: گواهی ما قطعاً از گواهی آن دو درست‌تر است، و [از حق‌] تجاوز نکرده‌ایم، چرا که [اگر چنین کنیم‌] از ستمکاران خواهیم بود.

Eğer bu şahidlerin günah işlemiş oldukları ortaya çıkarsa ölene daha yakın hak sahibi diğer iki kişi bunların yerine geçer ve "Bizim şahidliğimiz ikisininkinden de daha doğrudur, biz aşırı gitmedik, yoksa şüphesiz zulmedenlerden oluruz" diye Allah'a yemin ederler.

Jika diketahui bahwa kedua (saksi itu) membuat dosa, maka dua orang yang lain di antara ahli waris yang berhak yang lebih dekat kepada orang yang meninggal (memajukan tuntutan) untuk menggantikannya, lalu keduanya bersumpah dengan nama Allah: "Sesungguhnya persaksian kami labih layak diterima daripada persaksian kedua saksi itu, dan kami tidak melanggar batas, sesungguhnya kami kalau demikian tentulah termasuk orang yang menganiaya diri sendiri".

پھر اگر معلوم ہوجائے کہ وہ دونوں گناہ کے حقدار ہوگئے ہیں تو ان کی جگہ دو دوسرے آدمی کھڑے ہوں گے ان افراد میں سے جو میت سے قریب تر ہیں اور وہ قسم کھائیں گے کہ ہماری شہادت ان کی شہادت سے زیادہ صحیح ہے اور ہم نے کسی طرح کی زیادتی نہیں کی ہے کہ اس طرح ظالمین میں شمار ہوجائیں گے

অতঃপর যদি জানা যায় যে, উভয় ওসি কোন গোনাহে জড়িত রয়েছে, তবে যাদের বিরুদ্ধে গোনাহ হয়েছিল, তাদের মধ্য থেকে মৃতু ব্যক্তির নিকটতম দু’ব্যক্তি তাদের স্থলাভিষিক্ত হবে। অতঃপর আল্লাহর নামে কসম খাবে যে, অবশ্যই আমাদের সাক্ষ্য তাদের সাক্ষ্যর চাইতে অধিক সত্য এবং আমরা সীমা অতিক্রম করিনি। এমতাবস্থায় আমরা অবশ্যই অত্যাচারী হব।
